Warranty

Sands Creek strives to provide high-quality architectural and design services. However, the nature of design work involves subjective interpretation and can be influenced by various factors beyond our direct control, such as construction processes, materials used by others, and changes in regulations. Therefore, our warranty is as follows:

1. Scope of Warranty

Sands Creek warrants that the design documents (e.g., drawings, blueprints) we provide will substantially conform to the specifications outlined in the Project Agreement at the time of delivery.

2. Limitations of Warranty

This warranty does not cover:

• Construction: We do not warrant the quality or execution of the construction work performed by contractors or other third parties based on our designs.
• Materials: We do not warrant the performance, durability, or suitability of materials selected or used by the client or contractors.
• Code Changes: We do not warrant that designs will remain compliant with future changes in building codes or regulations after the final design documents are delivered.
• Unintended Use: This warranty applies only to the intended use of the design documents as specified in the Project Agreement.
• Interpretations: Differences in interpretation of the design documents by contractors or regulatory bodies are not covered.

3. Client Responsibilities

The Client is responsible for:

• Ensuring the accurate communication of their needs and requirements.
• Reviewing and approving design documents at designated stages.
• Selecting qualified contractors for construction.
• Obtaining all necessary permits and ensuring compliance with applicable codes during construction.

4. Disclaimer of Other Warranties

EXCEPT FOR THE EXPRESS WARRANTY STATED HEREIN, SANDS CREEK HEREBY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

5. Remedies

If the design documents do not substantially conform to the specifications outlined in the Project Agreement at the time of delivery, the sole and exclusive remedy shall be for Sands Creek, at its option and expense, to revise the non-conforming documents to meet the agreed-upon specifications. This remedy is contingent upon the Client notifying Sands Creek in writing of the non-conformity within [e.g., 30 days] of the delivery of the documents.

6. No Warranty of Results

Sands Creek does not warrant that the final built project will achieve any specific aesthetic outcome, market value, or other subjective result.
